I. Background:
Viet Nam is still regarded as a significant link in the global and regional illegal wildlife supply chain despite the Government’s efforts to improve the legal framework for wildlife protection, as well as strengthen law enforcement since the enactment of the Penal Code 2015 (revised in 2017), Law Forestry 2017 and relevant by-laws documents.
Many stakeholders are involved in the prevention and combat of illegal wildlife trafficking in Vietnam, including Forest Rangers, the Forest Protection Task Force, Environmental/Economic Police, Investigation Police, Customs, Border Guards, Market Management, CITES management agency, People's Procuracy, Court… all have various functions and responsibilities depending on the management scope or the nature and severity of violations. However, the abuse of positions and powers leading to violations of state management might occur during the application of administrative rules, processes, procedures, etc.; or risks brought on by geographic and environmental conditions result in limitations on the inspection, examination, and supervision of law enforcement activities…
As stated in Directive No. 29/CT-TTg dated July 23, 2020, on some urgent solutions for wildlife management, the Prime Minister proposed the Supreme People's Procuracy and Supreme People's Court to closely coordinate with the investigating bodies in directing and promoting the investigation and prosecution of offenders committing acts of hunting, catching, buying, selling, transporting, slaughtering and storing wildlife illegally; improve the quality of handling and adjudicating cases related to wildlife protection; particularly emphasizing on the application of strict punishments to the masterminds and leaders who abuse their positions and powers to commit wildlife crimes.
To enhance the participation of conservation organizations in proposing preventive measures to mitigate violation risks in wildlife protection activities, WCS is seeking a consultant group to design survey tools for assessing the threats and risks of violations in the wildlife management and enforcement of wildlife protection legislation in Viet Nam.
II. Objectives:
Design survey tools for assessing the threats and risks of violations in the wildlife management and enforcement of wildlife protection legislation in Viet Nam to:
- Identify activities of potential threats and risks of violations;
- Identify the threats and risks of violations;
- Identify vulnerability roles within organizations;

1. Develop the design survey tools for assessing the threats and risks of violations in the wildlife management and enforcement of wildlife protection legislation
- Review the regulations on functions and responsibilities and procedures in management and handling of violations of wildlife protection by State management agencies, law enforcement and judicial agencies;
- Research threats and risks of violations identified at each stage along the wildlife supply chain and process of handling relevant violations (provided by WCS Viet Nam);
- Consult with WCS Viet Nam on the appropriate approaches, assessment methods and survey tools design;
- Design survey tools for assessing the threats and risks of violations in the wildlife management and enforcement of wildlife protection legislation;
- Develop the risk categories, risk likelihood, and risk grading for proposing a risk treatment plan;
- Finalize draft survey tools;

2. Consult on the feasibility of survey tools
- Introduce the draft toolkit in the technical workshop held by WCS Viet Nam;
- Discuss and synthesize opinions of participants from state management agencies, law enforcement and judiciary agencies, training and research institutions

IV. Requirements (selection criteria):
The consultant group responsible for coordinating with WCS Viet Nam and partners to implement the activities must meet the following criteria:
Team leader (1 person):
- Have Bachelor/Master degree in Law, social science, state governance and other relevant fields
- At least 10 years of experience related to laws, anti-corruption or research and teaching of anti-corruption in Viet Nam.
- Strong research/survey design, analytical skills, presentation skills, and assessment methodology with proven research and reporting records;
- Having an understanding of illegal wildlife trade and counter wildlife trafficking in Viet Nam shall be an advantage.
Team member(s) (2 person):
- Have Bachelor/Master degree in Law, social science, state governance and other relevant fields;
- At least 03 years of experience related to laws, anti-corruption or research and teaching of anti-corruption in Viet Nam;
- Familiarity with assessment methodology, the design of questionnaire forms and reporting;
- Having an understanding of illegal wildlife trade and counter wildlife trafficking in Viet Nam shall be an advantage.
