Background  Over the past years, Viet Nam has exerted tremendous efforts to complete the national legal framework for wildlife protection; especially regulations on administrative and criminal sanctions against wildlife protection violations. However, in the process of implementation, it has been revealed that there remain some gaps and loopholes in the legal framework, which leads to inconsistent application of related regulations for law enforcement and judicial agencies, particularly regarding African pangolin scales, integral parts of wildlife, wildlife’s products, …  In that context, WCS would like to procure consultancy services to help develop visual guideline materials on the procedures for handling cases of violating legal regulations on wildlife protection (both in print and electronic formats). These materials will support the relevant authorities in effectively handling wildlife-related cases.  II. Objectives:  Provide guidance & disseminate the process of handling violations related to wildlife protection and notable issues for law enforcement officials, prosecutors, and judicial officers at the local level who directly handle wildlife-related cases;  Propose solutions to resolve difficulties and obstacles in handling wildlife-related cases and give relevant solutions. Develop and edit detailed content for publication materials (writing documents, filming...);  9. Background:  Pre-COVID-19, people from Quang Binh province were often recruited and brought to other countries like Malaysia, and Korea…for working, both via official and unofficial gateways. In 2018 and 2019, in the whole province, more than 7 thousand workers were working abroad through official channels. During the COVID-19 period, these activities seemed to have slowed down due to the strict travel, disease controlling and immigration policies in Viet Nam and other countries. In 2020, according to statistics from the Department of Labor, War Invalids and Social Affairs of the province, only about 2 thousand workers in Quang Binh province were allowed to go abroad to work through official channels. From the end of 2022, in a post-COVID context, the local government continued the policies, support, and promotion of the recruitment of residents for labour export. With the support and promotion from the local government, the number of people who registered for labour export increased. However, besides the majority of workers registering to work abroad through official channels; many organizations and individuals also find ways to bring Quang Binh workers abroad illegally under the guise of "labor export", or conduct illegal immigration activities. While many workers are motivated to work to elevate their financial status, a few workers changed the goal of their trips to a more negative direction such as running away to find another job instead of fulfilling the signed labor contract with the employers, or participating in illegal activities in the host country; this brought negative impacts to Viet Nam as well as other residents. To further understand this issue, WCS Viet Nam plans to conduct a quick research/survey to collect and analyse information regarding Vietnamese citizens from Quang Binh going to Malaysia as labour export post-COVID-19; the finding from this research/survey will serve as the basis for further research and intervention in the future. WCS Viet Nam needs to recruit consultants to carry out this research/survey on the situation of migrant workers from Quang Binh to Malaysia II. Objectives: To get an update situation of the citizens of Quang Binh who work in Malaysia through official and unofficial channels and their issues while working and staying in Malaysia, including violation of legal regulations of the host country, since post-COVID-19 up to the date. To date, three reports for the periods of 2013-2017, 2018-2019, and 2020-2021 have been developed and published. Implementing the cooperation plan between WCS and the SPP in 2023-2024, WCS Viet Nam will continue to work with the SPP’s Department 2 to assess the wildlife violations nationwide; and develop a report on the situation of wildlife crime and the law enforcement response in Viet Nam in 2022-2023. To support WCS Viet Nam and the SPP’s Department in implementing a series of activities to prepare, collect, and analyze data and then develop the report, WCS Viet Nam needs to recruit a consultant group to carry out some specified tasks. Data analysis and report development: Study and review three reports from the previous periods and propose an outline for the report on the situation of wildlife crime and law enforcement responses in Viet Nam for the period of 2022-2023. Analyse collected data and develop a report by using the approved report outline, including revising and finalizing the report based on comments from WCS Viet Nam,  the SPP’s Department 2, and other independent experts who are selected and proposed by WCS Viet Nam. The content of the report includes three main parts but is not limited to: Wildlife crime situation (number of cases, types of violations, violated species, etc.); Results of law enforcement efforts of the criminal justice system. Advantages and disadvantages in the application of the relevant laws and policies; and recommendations to improve the legal framework and enhance the effectiveness of law enforcement and judicial agencies. Background:  Wildlife-related crime is considered a transnational organized crime and is associated with other types of crime such as money laundering, tax evasion, and corruption. Wildlife traffickers are using more sophisticated methods and information technology to move, hide and launder their illicit proceeds, such as cash smuggling, trade-based money laundering, shell companies, and other informal value transfer systems, and cryptocurrencies. Cyber-enabled crime has grown rapidly in recent years, along with the growth of the internet, usually outpacing the ability of law enforcement officers to counter it. While wildlife traffickers make direct use of cyber platforms to sell illegal wildlife products, they also make use of the digitization and globalization of financial systems to obscure profits and circumvent traditional checks on financial activity. In Viet Nam, according to Article 3 of the Resolution 3/2019 of the Supreme Court’s Judge Council, wildlife crime is considered as a predicate offence for money laundering crime. WCS’s training needs assessment with selected prosecutors and judges in Viet Nam have identified that they mostly focus on handling the predicate offences which are the offences against regulations on the management and protection of wild animals, and offences against regulations on the management and protection of endangered, rare animals, but not their illicit proceeds as the subject of money laundering offence. There are a few reasons for this problem including a lack of knowledge on conducting and monitoring the financial investigation into wildlife crime to explore the types of evidence that need to be collected during law enforcement operations, identify offenders and assets obtained with proceeds of crimes; and limited skills to examine financial documents, trace and analyze financial flows. Since December 2022, WCS Viet Nam conducted a literature review on wild meat trade and consumption in Viet Nam with a focus on the North; and a Knowledge, Attitude and Practices (KAP) survey  on wild meat consumption in selected restaurants in Ha Noi and Bac Ninh and Ha Nam, Viet Nam to have an overview the situation of wild meat trade and consumption with the impact of COVID-19 pandemic. With the inputs from literature reviews and KAP survey, WCS developed a crime script on the wildlife trade and consumption applicable in the three surveyed locations. Results will be used to develop a crime preventative strategy combining enforcement and behaviour change interventions. WCS would like to conduct consultations workshop with related stakeholders from Ha Noi, Ha Nam and Bac Ninh to vet information and get more inputs, comments on the crime script and crime preventative strategy this November 2023. Therefore, WCS is seeking a consultant to support us in researching this issue. Results of this research could be presented in  workshop/s on the topic hosted by WCS and its government partners and be a good reference for different agencies. II. They will process criminal information, institute the cases, and carry out some initial investigations before transferring the case files to investigating police, even in less serious criminal cases with clear evidence, forest rangers can transfer the case file directly to a competent procuracy. However, in fact, the rangers don’t proactively implement investigative activities but engage the police immediately when detecting a case with criminal signs. Admittedly, they lack the skills to solve criminal offenses related to forest and wildlife protection violations. Vietnam National University of Forestry (VNUF) is a leading and official training institution in the forestry sector and provides an important personnel source for the national forest ranger force, however, its training curriculum mainly focuses on providing knowledge and techniques related to silviculture and forest resource protection and management but lacks of legal knowledge and law enforcement skills (such as detection, investigation, case profile preparation for prosecution) to deal with forestry crimes and violations. Therefore, WCS will collaborate with VNUF to integrate skills in detecting and handling violations in the forestry sector into the training program at VNUF. WCS Viet Nam Program Overview  WCS has been working in Viet Nam since 2006, focusing on strengthening the commitment, capacity, and actions of the government of Vietnam to combat wildlife trafficking. Through support and cooperation with executive and judiciary sectors, including the Ministry of Public Security, Supreme People’s Court, Supreme People’s Procuracy, Ministry of Justice, Ministry of Agriculture and Rural Development, and the National Assembly, it has provided and shared intelligence on criminal wildlife networks which help generate well-informed decisions in enforcement operations. WCS Viet Nam has generated a wide range of reliable data on a number of related issues on illegal wildlife trade, trained and briefed about 4,000 law enforcement officers, policy makers, journalists, researchers, and managers nationwide in investigation and enforcement techniques, legal barriers and distributed a number of technical handbooks and guides. It has assisted central agencies in reviewing and proposing necessary changes to national legislation, criminal intelligence analysis systems, and inter-agency cooperation. WCS has also facilitated Government to Government dialogue through multilateral and bi-lateral collaboration efforts between Viet Nam and Asian, African, and Latin American countries, to detect and respond to illegal wildlife trade networks. Its wildlife health expertise has been leveraged to address unregulated wildlife trade and mitigate pandemic threats through collaborative research, training, and policy development. Recently, WCS Viet Nam has also expanded to species conservation, with a focus on finding and protecting Rafetus Swinhoei in the wild.  III. Job Summary  Under the supervision of the Country Director, the WH&C Team Leader is responsible for:   Overseeing  wildlife health and species conservation projects in consultation with relevant WCS Viet Nam Program Managers, Turtle Conservation Coordinator (NY-based Species Program), and WCS NY’s Health Programs, including development, execution, coordination, and monitoring related activities;  Contributing to the technical works of the team and providing technical inputs to other related grant activities;  Building and maintaining effective relationships with relevant government agencies, the donor community, research and academic institutions, and individuals in wildlife conservation in Viet Nam.   IV. Responsibilities  A. Grant/Project Development and Implementation  Oversees the team’s work plans and budget from inception to execution and reporting;   Leads the implementation and monitoring of the team’s activities in Viet Nam;   Oversees the procurement and inventory of supply and equipment, including reagents, diagnostic kits, and consumable materials for animal health and species conservation works;   Provides veterinary/health and species conservation technical inputs into other WCS team’s products, e.g., grant reports, IEC materials, training materials, policy briefs, and vice versa;   Generates reliable and professional data to catalyze conservation action (report, map, infographic, statistic...) and scientific evidence of zoonotic transmission in wildlife trade chain in coordination with WCS and WCS’s partners, as relevant;   Oversees the work of the sub-grants, if any, including field-based surveillance activity;   Provides inputs into and assures the quality of relevant reports and updates;  Provides inputs in grant proposal development, including technical and financial ones;  B. Data Management and Analysis Oversees the field data collection, data entry, and data management associated with sample collection and tests, and animal management associated with species diversity survey, in-/ex-situ conservation programs;  Leads the production of scientific papers, manuscripts, and publications;   Oversees and maintains the database of the WH&C team’s partners, training events, and project reports.  C. Networking and Partnership 1. Establishes and maintains good working relationships with relevant sub-grants, in-country partners, Vietnamese government agencies, laboratories, and research/academic institutions.  D. In addition, the authorities have issued new Decrees and guiding circulars to amend, supplement and guide the implementation of legal regulations related to wildlife protection. These documents have partly resolved the remaining legal issues in wildlife protection activities and dealt with violations in the previous period.  In 2021, the Criminal Code 2015 was amended and supplemented to resolve some inadequacies in settling criminal cases. However, the content of Criminal Code 2015 (amended and supplemented) has not identified typical issues to assist authorities in criminal settlement related to wildlife effectively.  In this context, WCS Viet Nam would like to recruit an experienced expert to support and develop the report on “Reviewing the provisions of the Criminal Procedure Code applied in settlement of criminal cases related to wildlife in Viet Nam.” 2. Objectives:   Identify difficulties in the process of implementing and applying regulations of the Criminal Procedure Code;  Find out the gap and legal conflicts between the Criminal Procedures Code’s regulations and other relevant regulations;  Identify typical issues that need to be noticed by authorities in settlement of related wildlife criminal cases;  Propose possible solutions or amendments to current regulations for effectively improving the Criminal Procedure Code in practical application 3.
